These Terms and Conditions (“Terms”) apply to all users—caregivers and employers—who access or use our website, services, and tools. Please read carefully before registering or posting a profile.

2. Definitions

• “Platform” means CaregiversInCanada.com and all related subdomains, tools, and applications.

• “Caregiver” means any individual who creates a profile offering caregiving services.

• “Employer” means any individual or entity seeking to hire a caregiver.

• “Profile” means the information, documents, and media a caregiver uploads.

• “Services” means the matching, messaging, recruitment, and support tools we provide.

3. User Accounts and Obligations

3.1 Eligibility

You must be at least 18 years old and legally permitted to work in Canada to register.

3.2 Registration

Users must provide accurate, complete information. You agree to update your account details promptly if they change.

3.3 Security

You are responsible for safeguarding your password and account. You must notify us immediately of any unauthorized use.

4. Platform Services

4.1 Caregiver Profiles

Caregivers may create multimedia profiles, set availability, and display verification badges. All content must be truthful and lawful.

4.2 Employer Tools

Employers may search, filter, compare profiles, and message caregivers. Use of messaging and scheduling tools must comply with these Terms.

4.3 Recruitment Services

For employers who opt in, we provide end‑to‑end recruitment support under the Canada Caregiver Pilot Program. Fees and scopes are defined in separate Service Agreements.

5. Fees and Payments

5.1 Connection Fee

Employers pay a one‑time connection fee when they decide to hire. The amount is displayed at time of hire.

5.2 Recruitment Service Fees

Recruitment Services incur additional fees as per chosen package (Basic, Professional, Enterprise). All fees are disclosed upfront.

5.3 Payment Terms

Payments are processed via secure third‑party gateways. Failure to pay may result in account suspension.

6. Content and Conduct

6.1 Acceptable Use

You agree not to post illegal, defamatory, or infringing content. You will not harass, discriminate, or spam other users.

6.2 Intellectual Property

You retain ownership of your content. By posting, you grant us a license to display and distribute it. All platform design and code remain our property.

6.3 User Reviews

Reviews and ratings must be honest and based on real interactions. We reserve the right to remove abusive or fraudulent reviews.

7. Privacy and Data Protection

Your use of personal data is governed by our Privacy Policy. We employ encryption and security measures to protect user data. By using the platform, you consent to our data practices.

8. Dispute Resolution and Liability

8.1 Mediation and Escrow

We provide escrowed payments and a mediation process for disputes. Both parties must attempt mediation before pursuing legal remedies.

8.2 Limitation of Liability

To the maximum extent permitted by law, our liability is limited to fees paid in the prior six months. We disclaim all indirect or consequential damages.

8.3 Indemnification

You agree to indemnify CaregiversInCanada.com against any claims arising from your breach of these Terms.

9. Termination

We may suspend or terminate accounts for violations of these Terms or for inactivity. Users may delete their accounts at any time; fees already paid are non‑refundable.

10. Modifications to Terms

We may update these Terms with 30 days’ notice posted on the site. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of Canada and the province of Ontario, without regard to conflict‑of‑law principles.
